Albuquerque Metro Court Warrants

If you have just discovered your old Albuquerque Metropolitan Court Warrant, the odds are that you were trying to renew your license, and were told that your license is suspended due to a Bernalillo County Metro Court Warrant. Before you will be able to have the suspension lifted, you will need to have the traffic warrant cancelled or quashed. Once we have taken care of the traffic warrant, we will receive a license clearance document from the court. We will send the clearance to the New Mexico Motor Vehicle Department for you, and all that is left is the payment of a small (usually $25) reinstatement fee. In many cases, we have been able to get the reinstatement fee waived for our out of state clients. Once the reinstatement fee is paid or waived, and the clearance is filed with MVD, it usually takes about 48 hours for the clearance to hit the computer system, after that, you can return to your local Motor Vehicle Department and get your license.

The first thing we will do for you is look up your case and determine what the bond is for your warrant. Many traffic warrant cases will require that a cash bond is posted with the Albuquerque Metro Court. Once we have determined the amount of your Metro Court Bond, we will contact you and make arrangements to post the bond for you. We will collect the bond amount from you (along with our fee) and deposit it in a client trust account. This special account is required by law, and enables us to post your bond with Metro Court by use of a trust check.

When we post your bond at Albuquerque Metro Court, the clerk will immediately cancel the warrant. This means that once bond is posted you will not have to worry about being arrested for the Metro Court Warrant.

After the warrant is canceled, the clerk will issue the driver’s license clearance discussed above, so that you can get your license reinstated. Next the clerk will set a court date for you to appear both for the Metro Court Warrant and the underlying charge. Glenn and his team will immediately inform you of your new Metro Court date.

For most of our Metro Court Warrant cases, especially those involving minor traffic violations, like speeding, no insurance, or even more serious traffic violations like driving on a suspended license, reckless or careless driving, we are able to waive the appearance of our out of state clients. We will file the appropriate paperwork called a Waiver Of Appearance along with a Power of Attorney form and an Entry of Appearance that allows us to appear on your behalf. If the Metro Court Judge grants the Waiver of Appearance (and they usually do), you do not have to appear in Metro Court, and we will appear for you.

When Mr. Valdez appears for you at your court date, he makes sure that the two of you have discussed your goals and objectives. Primarily, the goal is always a dismissal of all the charges, including the Failure to Appear that resulted in the Metro Court Warrant. For older Warrant cases, the original charges will be dismissed if the Officer who charged you doesn’t appear for court. In some cases, the Officer may appear, but cannot remember issuing the citations or the circumstances that resulted in the charge, and most of those cases are dismissed as well, as Glenn has a great reputation as an aggressive and excellent trial litigator. Like most of us, the last thing an Officer wants to experience is a cross examination where he or she would have to admit they don’t remember why they did something. Even in those cases where the Officer appears and does remember the case, Glenn can often persuade the Officer to agree to dismiss the citation, allow the defendant to make a small donation to the Crime-stoppers program or some other local program and then dismiss, or agree to a deferred sentence, where a no-contest plea is entered and court costs are assessed, but the charge is dismissed after 30, 60, or 90 days. All of the possibilities will be discussed with you so that you know your options when you make the final decision about your Metro Court Case.
